Ministry of Industry and Trade proposes to cut 19 administrative procedures in import and export sector

There are 19 administrative procedures in the field of import and export proposed by the Ministry of Industry and Trade to be cut because they are no longer suitable in practice.
According to Official Letter No. 6613/BCT-PC dated August 30, 2024 on providing comments on the draft Plan to reduce and simplify regulations related to business activities of the Ministry of Industry and Trade in 2025, there are 19 administrative procedures in the field of import and export proposed by the Ministry of Industry and Trade to be reduced.
According to the Ministry of Industry and Trade, implementing Resolution No. 68/NQ-CP dated May 12, 2020 of the Government promulgating the Program to reduce and simplify regulations related to business activities in the period of 2020 - 2025, the Ministry of Industry and Trade continues to review regulations related to business activities under its management. At the same time, develop a plan to reduce and simplify regulations related to business activities in 2025 of the Ministry of Industry and Trade.
Specifically, regarding the plan to reduce and simplify regulations related to business activities under the management of the Ministry of Industry and Trade in 2025, the Ministry of Industry and Trade proposed to reduce 19 administrative procedures related to the import and export sector. Specifically:
Administrative procedure 1: Granting certificate of registration of export and import rights of foreign traders without presence in Vietnam (TTHC code: 1.000350)
Regarding the reduction content: Decentralize administrative procedures for granting certificates of registration of export rights and import rights of foreign traders without a presence in Vietnam from the Ministry of Industry and Trade to the Department of Industry and Trade representing in Vietnam from the Ministry of Industry and Trade to the Department of Industry and Trade.
The reason is based on the decentralization of administrative procedures/groups of procedures in the field of import and export according to Decision 1015/QD-TTg, in order to facilitate enterprises in the process of implementing administrative procedures.
Proposed implementation: - Amend and supplement Article 6, Article 9 of Decree No. 90/2007/ND-CP dated May 31, 2007 of the Government regulating the export rights and import rights of foreign traders without a presence in Vietnam.
- Amend and supplement Clause 1, Article 4, Article 12, 13 of Circular No. 28/2012/TT-BCT dated September 27, 2012 of the Minister of Industry and Trade detailing the registration of export and import rights of foreign traders without a presence in Vietnam.

Administrative procedure 2: Re-issuance, amendment, and supplementation of Certificate of registration of export and import rights of foreign traders without presence in Vietnam (TTHC code: 1.005405)
Reduction content: Decentralization of administrative procedures for re-issuance, amendment, and supplementation of certificates of registration of export rights and import rights of foreign traders without a presence in Vietnam from the Ministry of Industry and Trade to the Department of Industry and Trade.
Reason, based on the implementation of decentralization of administrative procedures/groups of procedures in the field of import and export according to Decision 1015/QD-TTg, in order to facilitate enterprises in the process of implementing administrative procedures
Recommendation for implementation: Amend and supplement Article 6, Article 12 of Decree No. 90/2007/ND-CP dated May 31, 2007 of the Government regulating the export rights and import rights of foreign traders without a presence in Vietnam; Amending and supplementing Clause 1, Article 4, Article 12, 13 of Circular No. 28/2012/TTBCT dated September 27, 2012 of the Minister of Industry and Trade detailing the registration of export and import rights of foreign traders without a presence in Vietnam.

Administrative procedure 3: Extension of Certificate of registration of export and import rights of foreign traders without presence in Vietnam (TTHC code: 1.005406)
Reduction content: Decentralization of administrative procedures for extending certificates of registration of export rights and import rights of foreign traders without presence in Vietnam from the Ministry of Industry and Trade to the Department of Industry and Trade Reason: Based on the implementation of decentralization of administrative procedures/groups of procedures in the field of import and export according to Decision 1015/QD-TTg, in order to facilitate enterprises in the process of implementing administrative procedures.
Recommendation for implementation
- Amend and supplement Article 6, Article 13 of Decree No. 90/2007/ND-CP dated May 31, 2007 of the Government regulating export rights and import rights of foreign traders without presence in Vietnam.
- Amend and supplement Clause 1, Article 4, Article 12, 13 of Circular No. 28/2012/TTBCT dated September 27, 2012 of the Minister of Industry and Trade detailing the registration of export and import rights of foreign traders without a presence in Vietnam. Roadmap: 2025.
Administrative procedure 4: Procedure for granting manufacturer identification number (MID) for textile and garment products exported to the United States (Administrative procedure code: 1.000113)
Reduction content: Abolish the procedure for granting manufacturer identification numbers (MIDs) for textiles exported to the United States.
Reason: The previous regulation on granting MID codes was temporary, to support enterprises exporting to the United States for the first time and also to demonstrate to the United States about self-control of enterprises, combating trade fraud, and combating transshipment when the United States is applying a strict monitoring mechanism that has never been applied to textile exporting countries in the world exporting to the United States.
Currently, the US monitoring mechanism has been abolished for more than 10 years, exports are taking place normally, and there is no need for the participation of state management agencies in granting MID codes.

- Abolish Circular No. 16/2010/TT-BCT dated April 20, 2010 of the Minister of Industry and Trade on granting Textile and Garment Manufacturer Codes (MID) for export to the United States
- Roadmap: Included in the draft Circular to abolish Circulars of the Ministry of Industry and Trade (expected to be issued in 2024).
